Pop-A-Lock Franchise Sues AAA Pop-A-Lock In Florida For Trademark Violations.

OCALA, February 17, 2009 -- SystemForward America Inc., the owners of the Pop-A-Lock franchise, filed suit today in the U.S. District Court for the Middle District of Florida against a business calling itself AAA Pop-A-Lock.

Louisana-based SystemForward America Inc.'s ("SystemForward") offers vehicle door unlocking services in addition to emergency roadside assistance and locksmithing services under the POP-A-LOCK brand and variation thereon.

SystemForward has federally registered the marks POP-A-LOCK (registered since 2000), POP-A-LOCK A CAR DOOR UNLOCKING SERVICE (registered since 1993), and POP-A-LOCK "TRUSTED LOCKSMITH" (registered since 2007).

AAA Pop-A-Lock filed for incorporation with the Florida Department of State on April 5, 2005 and allegedly offers vehicle door unlocking services in addition to emergency roadside assistance and locksmithing services.

SystemForward is asking the court for injunctive relief to stop further use of the mark AAA Pop-A-Lock in addition to compensatory damages and penalites. In addition to a claim for trademark infringement, SystemForward has also pled trademark dilution and unfair competition.
