Some law firms charge an hourly rate to prepare and file an application to register a trademark, while some purport to charge a flat rate without making it clear that additional fees may apply. Most of them do not publish their rates in any evemt. The Brandwise Law Firm, P.C. is different. We strive to provide people with information to make an informed choice. We also believe it is important that client's truly understand how and when fees will be incurred. Our a la carte approach is designed to work with a client's budget and comfort with risk. If you would like to schedule a consultation or to retain our services, please contact us. Consultation FeesWe charge a fee of $100 for a telephone consultation. If you decide to retain our services, the consultation fee will be credited towards one matter. Trademark ClearanceTrademark clearance involves two parts. The first part is the performance of a comprehensive search to try to determine if a confusingly similar trademark is being used. The Brandwise Law Firm, P.C. contracts with various companies to perform the search without taking any mark-up. To provide an idea of how much search fees could be, our vendors currently charge the following rates which are subject to change. A Standard Character (i.e. word) search for the U.S. is $345 per mark. The cost of a Special Form (i.e. graphic) search for the U.S. depends on the number of classes to be searched and costs between $445 and $1,550. Please contact us about international searches. The second phase of the trademark clearance process is the analysis of the report and the creation of a written opinion, for which we charge our normal hourly rates. The time spent on any given trademark will depend on the length of the search report and the unique issues presented. Legal ServicesOur trademark attorneys realize that most law firms do not publish their rates. Our trademark lawyers have decided to publish their rates in the interest of nurturing a positive relationship with its clients that is based on trust, communication and enabling people to make informed decisions. We want to gain your trust, but trust has to be earned. We charge a flat rate Application Fee to prepare and file a trademark registration. If additional work is required after the application is filed, we reserve the right to charge at our hourly rates. This is because any number of things, which are beyond our control, can happen after the application is filed. In some cases, the work involved only takes a few minutes. In those cases, we usually don’t charge anything. However, if the needed action represents a significant time commitment, we reserve the right to charge for the time spent. Time is tracked in 6 minute increments. Our current Application Fees are as follows:
Filing FeesThere are simply too many variables to include filing fees into one all-encompassing flat fee for every trademark application. The various entities that grant trademark registrations, usually government agencies, have different filing fees which are subject to change without notice. Some of the entities also have different kinds of applications, which have different filling fees, like the United States Patent & Trademark Office (USPTO). Additionally, your enterprise is unique with its own objectives. Trademarks are usually associated with goods and/or services, which are sometimes divided into different classes. Your application will have to reflect the unique combination of goods and services that you provide. Your application may also require a Statement of Use which requires an additional filing fee. Lastly, you may or may not want to register your mark internationally which also has filing fees associated with each country having its own filing fee. To make matters even more complicated, filing fees under the Madrid Protocol, which allows for international trademark registrations, are stated in Swiss francs which are subject to daily flucuations in the exchange rate against the U.S. dollar. To provide an idea of how much filing fees are, the USPTO currently charges the following fees. Most applications are filed as a TEAS PLUS application.
